The Failure of the 28-Point Peace Initiative for Ukraine: Why Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the tension caused by the presentation of a new 28-article proposal for ending the war appeared – briefly – to have been defused. A Washington representative spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its response: another massive barrage of missile and drone strikes on Kyiv.

The Pattern of Negotiation and Warfare

The succession of opposing developments captured the bleak nature of the outgoing year. By day, negotiation efforts are waged: hopeful statements are delivered from multiple capitals. Significant resources is devoted on containing particular approaches. By night, Moscow brutally reminds the world that, for them, conflict continues to be the key method for achieving "resolution".

Nighttime Reality

As the offensive progressed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was laid bare. Ukraine is equipped to monitor missile launches from Russian territory, a capability provided through up-to-date information. From observation points, military aircraft that had been deployed to intercept incoming guided weapons flew past – sophisticated military planes supplied to Ukraine by European allies.

Shortly after, Kyiv's missile defense activated: several firings targeted at a incoming threat. This was a modern interception technology at work, probably delivered by Western nations. Every launch shakes the surroundings, causing tremors. The brief panic quickly becomes grim resignation: maybe the approaching threat won't hit its mark this time, protecting urban areas from catastrophe and further power outages.

Persistent Threats

Not long after, a automatic firearm fired at a unmanned aircraft in the vicinity, part of a mobile-fire group – most likely allied-provided weaponry. Unfortunately, the shots failed to hit the opposing UAV – it maintained course toward its destination.

With pauses, this persisted until dawn. Kyiv awoke to the morning news: several casualties, damage and heating outages in many homes as a result of the nocturnal offensive. As typically, everyone still went about their day – enduring hostilities. But those entire period encapsulated Ukraine's vital need on Western support – a need that European nations are clearly incapable to replace in the near term.

Unsuccessful Negotiations

The comprehensive proposal from American leadership generated strong feelings, discussion and serious worry – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and international summits.

Every new approach from Washington follows the consistent cycle: a political offensive against Ukraine, which Kyiv, with allied governments, effectively counters. They stabilise the situation but never actually secure success. This pattern will, certainly, continue.

Strategic Calculations

It is convenient to criticize certain parties of repeatedly advocating Moscow's conditions. But that does not seem to be the entire situation. American leadership operates on a principle understood by seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The American government presumes that it is unrealistic to compel Moscow to abandon the territory that it presently holds in Ukraine's occupied territories.

The problem is that while recognising this factual reality, US leadership does nothing to deter Moscow, through words or deeds, from believing that the current condition will not change more in its benefit in the near future.

Conflicting Perspectives

Therefore, Russian leadership is confident that time is on his side – that Ukraine and its partners are coming close to fatigue. Their incentive to sign a deal that does not give them the largest achievable advantage is virtually nonexistent. There may be multiple initiatives to achieve ceasefire, but they will carry on as long as Russia's leader remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still persist, slowly losing lives and land but preventing a total frontline collapse until conditions improve in its benefit.

Present Conditions

Factually, there are no real preconditions for a ceasefire. Now, subjective factors are entering the equation: personal goals to mediate resolution and obtain worldwide acknowledgment, and Kyiv's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the flag against any initiative Kyiv finds unworkable, so that their attention does not switch to homefront challenges. And although their mission will now be much harder after latest incidents, it remains very improbable that this will modify their basic position.

These two forces are influencing discussions.

Conclusion and Outlook

It took a just a single week to kill the proposed articles of the latest plan. Forceful and unpredictable management of the matter by US administration, opposition by Ukraine and the other European countries, along with pacifying measures of representatives, and finally, recent disclosures, all served their function.

While new proposals based on previous concepts are imminent, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are founded on Moscow's terms and reflect certain reluctance to modify developments, if they remain united and enhance their military capacity at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the coming months, largely rely on continued Western support.
